Terms and Conditions

for the Sklep Zooz Online Store

I. General Information & Contact Details

  1. These Terms and Conditions ("Terms and Conditions") specify the rules and conditions of using the Sklep Zooz online store, available at https://sklepzooz.pl.

  2. The Store is owned and operated by AVIT SP. Z O.O., with its registered office at Brzegowa 68, 57-100 Strzelin, entered into the register of entrepreneurs of the National Court Register under KRS number: 0000401160, NIP: 9141562762, REGON: 021780421 ("Seller").

  3. Seller’s contact details are as follows:

II. Technical Requirements

To use the Store, you need:

  • a computer or other device with an internet browser,

  • access to the internet,

  • an active e-mail address.

III. Personal Data

The Seller is the controller of customers' personal data.

Full information about the processing of personal data of customers and other users of the Store’s website can be found in the Privacy Policy.

IV. Conclusion of Sales Agreement, Customer Account

  1. The Store enables the purchase of products (“Products”) displayed on the Store’s website in two ways:

    • without registration,

    • after creating an account in the Store.

  2. To place an order, select the desired Products, add them to the "Cart" and proceed with the ordering process by selecting the delivery and payment method.

  3. Product information in the Store, including descriptions and prices, constitute an invitation to conclude a sales agreement within the meaning of art. 71 of the Polish Civil Code, under the conditions set out in these Terms and Conditions.

  4. To place an order, the Customer must complete all mandatory data fields in the order form, necessary for fulfilment of the order (and optionally, for issuing an invoice).

  5. Creating an account (the “Account”) is a one-time registration. The Customer’s email address and password serve for subsequent logins. Details on using the Account are set out in the Account Terms. Logging in via social media or Google user accounts is also possible. After logging in, the Customer can access their order history and is not required to re-enter shipping details for subsequent orders.

  6. The Customer may resign from their Account at any time at no cost by sending an e-mail to: kontakt@sklepzooz.pl.

  7. Confirming the order by clicking "Buy and Pay" (or a similarly phrased button) means:

    • submitting an offer to purchase Products on the terms selected in the order and set out in these Terms;

    • accepting the obligation to pay the price for the Products and any applicable delivery costs.

  8. The Sales Agreement is concluded at the moment the Seller accepts the order for execution, of which the Customer is notified by email.

  9. If execution of the order (in part or in full) is not possible, the Seller will inform the Customer accordingly – in such case, the Sales Agreement is not concluded. The Seller may propose alternative options (e.g., partial fulfillment or waiting for restock). In case the order was prepaid and cannot be fulfilled, the Seller will promptly refund the payment (proportionally to the cancelled part).

  10. The Seller shall confirm conclusion of the Sales Agreement on a durable medium at the latest at the time of delivery of the Product.

  11. The Store shall not be liable for non-delivery or delays resulting from incomplete/incorrect shipping details provided by the Customer.

  12. The Seller reserves the right to suspend order processing if the Customer provides false or doubtful data. In such case, the Seller will attempt to contact the Customer for verification.

V. Prices and Payment Methods

  1. Prices of Products are presented in Polish zloty (PLN), including VAT.

  2. Delivery costs are shown separately in the Store’s Cart depending on the chosen delivery method.

  3. Available payment methods are listed on the Store’s website under "Payment Methods" and also displayed during the ordering process. These methods include:

    • bank transfers / BLIK / online wallets via payment platforms:

      • Shoper Payments (Autopay)

      • Przelewy24

    • payment by Visa, Visa Electron, MasterCard, MasterCard Electronic cards

    • cash on delivery

    • cash or card on personal pickup at the Seller’s stationary point

  4. For payments made via Shoper Payments, the service provider is Autopay S.A.

VI. Delivery of Goods

  1. Goods are delivered, according to the Customer's choice:

    • by courier,

    • by Poczta Polska,

    • to InPost parcel lockers,

    • by ORLEN paczka,

    • by personal collection.

  2. The Customer may collect the order in person at the Seller’s headquarters.

  3. Except for personal pickups, the order is considered completed at the moment it is handed over to the carrier. Actual delivery times depend on the chosen carrier.

  4. Goods are shipped within up to 5 business days (unless otherwise specified in the product description). Order processing times are listed on the Store’s website.

  5. Orders are processed within Poland according to the costs indicated under “Delivery Time and Costs.” International shipping is possible at the rates listed on the website or individually agreed with the Customer.

VII. Withdrawal from the Agreement (Right of Withdrawal)

  1. Customers who are consumers or so-called "Privileged Entrepreneurs" (as per art. 7aa of the Polish Consumer Rights Act) have the statutory right to withdraw from the sales agreement within 14 days of receiving the Goods, without stating a reason, except for exceptions listed below.

  2. To comply with the withdrawal deadline, it is sufficient to send the statement:

    • electronically to: kontakt@sklepzooz.pl, or

    • in writing to: ul. Brzegowa 68, 57-100 Strzelin, Poland.

  3. The statement of withdrawal may be submitted using the sample form here (use is not obligatory). The Seller will promptly confirm receipt of your withdrawal statement by email.

  4. The Customer should, at their own cost, return the Goods to Avit Sp. z o.o., ul. Brzegowa 68, 57-100 Strzelin, within 14 days from the statement.

  5. The Seller will promptly, no later than 14 days after receiving the withdrawal statement, reimburse:

    • the price of the Goods;

    • the initial standard shipping cost of delivery to the Customer.
      The Seller may withhold reimbursement until receiving the Goods back or proof of their return.

  6. The refund will be made using the same payment method as the original transaction unless another has been expressly agreed.

  7. The Customer is liable for any reduction in value resulting from handling the Goods other than as necessary to establish their nature, characteristics, and functioning.

Exceptions to the right of withdrawal

The right of withdrawal does not apply to agreements for the supply of:

  • non-prefabricated goods made to the Customer's specifications or to meet their individual needs (personalized goods);

  • perishable goods or goods with a short shelf life;

  • goods in sealed packaging which, after opening, cannot be returned for health or hygiene reasons;

  • audio/video recordings or computer software supplied in sealed packaging if unsealed after delivery;

  • goods which, after delivery, are inseparable from other items;

  • newspapers, periodicals, or magazines (other than subscriptions);

  • goods/services the price of which depends on financial market fluctuations beyond the control of the Seller;

  • alcoholic beverages agreed at the conclusion of the sale but deliverable only after 30 days, whose value depends on market fluctuations beyond the Seller’s control.

VIII. Complaints

  1. The Seller is obliged to deliver Goods in conformity with the Agreement.

  2. For consumers and Privileged Entrepreneurs, the Seller’s liability for conformity of the Goods is as per the relevant provisions of the Consumer Rights Act. For other Customers, the Seller’s liability is based on the Civil Code.

  3. Complaints may be submitted:

  4. The Seller will review the complaint via the same communication channel (email or post) within 14 days of receipt.

  5. If the Customer is dissatisfied with the Seller’s response, the consumer and Privileged Entrepreneur may (in addition to court proceedings) use alternative dispute resolution (ADR) options, such as:

    • applying to a provincial Inspector of the Trade Inspection for mediation;

    • seeking help from a local consumer ombudsman or social organization for consumer protection;

    • applying to a permanent consumer arbitration court;

    • using the ODR online platform (functionality to close July 20, 2025).

IX. Product Reviews

  1. The Store allows Customers to leave product reviews ("Reviews").

  2. Reviews must comply with the Digital Services Act (DSA) and good practices, particularly:

    • Reviews must not contain illegal content;

    • offensive, pornographic, religiously offensive, or hate-inciting material;

    • infringe others’ rights, especially copyrights and privacy rights;

    • contain commercial or advertising content about other products.

  3. The Seller and/or outsourced satisfaction survey providers may moderate Reviews; non-compliant Reviews may be withheld or removed.

  4. If a Review is blocked or removed, the Seller will inform the Customer and provide reasons. An appeal may be submitted:

    • by post: Avit Sp. z o.o., ul. Brzegowa 68, 57-100 Strzelin
      The Seller will acknowledge appeals by e-mail (if provided) and respond within 14 days.

  5. Any visitor may submit a notice ("Notification") to the Seller regarding illegal or non-compliant Reviews via e-mail to kontakt@sklepzooz.pl. The Seller will confirm receipt by e-mail and review within 14 days, providing reasons for any decision. Appeals follow the procedures above.

  6. If dissatisfied with the result, the person submitting the appeal may use out-of-court dispute resolution per the DSA.

  7. The Seller is not liable for Customer-submitted Reviews, provided that:

    • The Seller had no knowledge the Review was illegal, and

    • acts promptly to remove or block access to illegal content upon becoming aware, especially after receiving a Notification.

X. Governing Law & Final Provisions

  1. For all agreements concluded via the Store, Polish law applies.
    For consumers from other EU Member States, none of the provisions of these Terms excludes or limits the consumer rights granted by mandatory provisions of law applicable in their country of residence.
    Where Polish law does not provide appropriate protection, the relevant provisions of EU law and (if applicable) the law of the Consumer’s country of habitual residence shall apply.

  2. The Agreement is concluded in the Polish language. English-language translations and these Terms are provided for the Customer’s convenience.

  3. The Seller may amend these Terms and Conditions at any time. Any amendment applies to orders placed after the new version is published. For previously concluded agreements for digital or electronic services, and for Customers holding an Account, Customers will be notified and may reject the amended Terms.

  4. These Terms and Conditions are valid from July 4, 2025.

Account Terms

  1. The Account Terms supplement these Terms and Conditions. In areas not addressed herein, the main Terms and Conditions apply.

  2. Use of the Account is an additional, free-of-charge digital/electronic service.

  3. By creating an Account, the Customer enters into an agreement for the provision of this digital service for an indefinite period. The Customer may resign at any time without giving any reason, by e-mailing kontakt@sklepzooz.pl. The Customer also has the statutory right to withdraw from the Account service within 14 days of conclusion.

  4. Technical requirements and functionalities are as described in Section II above.

  5. While using the Account, the Customer may:

    • save and store personal data (including delivery address) for easier repeat purchases,

    • access order history and order status.

  6. Complaints regarding the Account are processed in accordance with Section VIII above.

  7. Full details on the processing of personal data (including for running the Account) are available in the Privacy Policy.

  8. The Seller may change these Account Terms under the rules described in Section X above. The Customer may terminate the Account service contract with 14 days' notice should they not accept the amended Account Terms.
